Terms and Conditions for giveaways

These Terms and Conditions apply to all giveaways run by LELOi AB, a limited liability company with its registered place of business at Karlavägen 41, Stockholm, Sweden. Participation in the giveaways is subject to the following Terms and Conditions. Each participant is deemed to have read, understood and accepted these Terms and Conditions in full.

These Terms and Conditions, any information shared in the social media posts where the giveaways are announced and operator’s Privacy Policy (https://www.lelo.com/privacy-policy), form the full and final contract governing the giveaway (the “Contract”). Please read all the provided information in the post, these Terms and Conditions and Privacy Policy carefully before entering the giveaway. By participating in the giveaway, you (the “participant”, “you” or “your”) accept the Contract.

Participation in the giveaway is voluntary and no purchase is necessary to enter or win a prize.

The giveaway is hosted solely by the Organizer and is not affiliated with any social media platform in any way and is not sponsored, supported or organized by any other company.

Timeline

Participation is only possible within the participation period, starting from Entry Date until Closing Date. Participations received after the Closing Date will not be considered.

Participants

The giveaway is open to all persons over the age of 18 (country-specific laws are to be observed).

Due to legal restrictions, residents of Italy are not eligible to participate in the giveaway. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, THE GIVEAWAY IS VOID, AND PERSONS ARE NOT ELIGIBLE TO ENTER THE GIVEAWAY, IN JURISDICTIONS WHERE LOCAL LAW, RULES, OR REGULATIONS (I) RESTRICT, PROHIBIT, OR OTHERWISE REQUIRE CHANGES, DELETIONS, OR ADDITIONS TO THESE RULES OR OUR TERMS OF SERVICE, OR (II) REQUIRE GOVERNMENTAL FILINGS BY SPONSOR. Individuals who participate in a giveaway but are not eligible for these reasons or for any reason under statutory or common law or any rule or regulation shall have any award canceled, and they must, at Organizer’s discretion, return any prize mistakenly delivered to them.

Not eligible to participate in the giveaway are persons involved in the conception and implementation of the giveaway and employees of the Organizer and their family members. In addition, the Operator reserves the right, in its sole discretion, to exclude persons from participation in the event of non-compliance with the conditions of participation, the use of technical means or other manipulative and/or unauthorized aids. This also applies in the event of multiple applications for participation for the same person and in the event of intentionally false personal details.

In addition, the Operator reserves the right to exclude participants already admitted at any time, including retroactively, and to refuse and reclaim prizes.

The participant is responsible for the accuracy of the required information. The Operator accepts no liability for incomplete or inaccurate information. Providing false information may result in disqualification from the giveaway or the prize draw.

Participation

The detailed requirements for participating in the giveaway will be posted on the Operator’s social media accounts and webpage, upon the commencement of the giveaway.

The participant can only participate with a single profile and/or email account on the designated platform where the giveaway is posted. It is strictly forbidden to use multiple email addresses or multiple profiles to increase the chances of winning.

Entry to a giveaway must comply with the following guidelines and restrictions:

Entry must not include or refer to untruthful, incomplete, inaccurate, or misleading information.

Entry must be made on its own behalf, as an individual, and not as a representative, agent, or employee of any third party.

Entry and social media accounts must not (in Organizer’s discretion): (i) violate any third-party rights, including copyrights, trademark rights, or rights of privacy and publicity; (ii) contain disparaging or defamatory statements; (iii) include threats to any person, place, business, or group; (iv) be obscene, offensive, or indecent; (v) depict any risky behavior; (vi) contain material that promotes bigotry, racism, hatred, disrespect, or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation, or age; or (vii) contain unauthorized third-party trademarks or logos.

The participant represents and warrants that its Entry: (i) does not violate any applicable law, rule, or regulation; (ii) complies with the terms of use and any community guidelines of the Social Media Platform through which the giveaway is entered (if applicable), as well as Organizer’s Terms of Use; and (iv) complies with all requirements of these Terms & Conditions.

Prize announcement and prize notification

The distributed prize is described within the initial giveaway post, published on the respective social media platforms.

The winner of the giveaway will be randomly selected through a draw between all the eligible participants. The announcement of the winner will be made by the Operator on the social media channels or webpage where the giveaway takes place. Once announced, the winner will be contacted by the Operator staff via email provided. The physical prize will be sent by mail.

The prize is personal and non-transferable. It will be awarded and delivered only to the winner. The prize cannot be exchanged for other products, services or cash. The prize is indivisible and can only be accepted as such. The Operator reserves the sole right to select the winner.

Any costs incurred for the delivery of the prize are covered by the Organizer. Any additional costs associated with the claiming of the prize shall be borne by the winner. The winner is responsible for the possible taxation of the prize.

If the winner does not respond within three (3) weeks after being contacted twice, another drawing shall occur and a new winner will be selected.

Giveaway changes and termination

The Organizer expressly reserves the right to change the course of the competition and/or modify the nature and scope of the prize, as well as to replace the prize with another one without giving reasons, until the prize is handed over.

The Organizer expressly reserves the right to terminate or cancel the giveaway without giving reasons or notification. This applies in particular to any reasons that would disrupt a planned procedure of the giveaway or would prevent it from doing so.

Privacy

The Operator is responsible for participants’ personal data processing as the Data Controller.

Processing of the personal data is necessary for the performance of the giveaway and, therefore it shall be processed solely for the purposes of the performance, management and follow up of the giveaway by the Operator.

The Operator processes participants' personal data for the proper implementation and processing of giveaways and in particular for sending the prize. In order to carry out the giveaways, the email address and/or social media profile information of the respective participant is collected and stored. When subscribing to the Operator’s newsletter, the email address of the respective participant is collected and stored. In order to send the prize, the Operator also collects the first name and the last name as well as the address of the winner(s) and passes this data on to a shipping company commissioned by the Operator. Participants’ personal data will not be passed on to third parties beyond this.

In the event of winning, the winner consents to the publication of their abbreviated name (first name only) and country of residence on the Operator’s website and social media platforms.

The participant can revoke his declared consent at any time. The revocation must be submitted in writing to the Operator (privacy@lelo.com). After revoking the consent, the collected and stored personal data of the participant will be deleted immediately.

After the end of the competition, participants personal data processed as part of the giveaway will be deleted no later than six (6) months after the end of the giveaway, unless there is effective consent for further processing (with regard to newsletter subscription) and/or there is no continued legitimate interest in further storage. Personal data of participants who consent to subscribe to the Operator’s newsletter will be processed for sending out newsletters and marketing materials until such consent is revoked.

Liability and Waiver

The Operator is released from all obligations upon delivery of the prize.

The Operator can exclusively be held liable for damages in case of intent or gross negligence by the Operator, or where the Operator otherwise is liable in accordance with applicable mandatory law. To the extent permissible under applicable laws, the Operator’s liability shall be limited to the value of the prize in the giveaway.

The Operator does not make any warranties, whether express, implied or statutory, other than what is expressly stated in the Contract. Access to the giveaway might depend on circumstances out of Operator’s control, including actions pertaining to third parties, such as the social media platforms and their availability, up- or downtime, data loss, functions etc. For errors, delays, damage, or other results based on circumstances pertained to such a third party, the Operator does not assume any liability.

Applicable law

Questions or complaints in connection with the giveaway must be addressed to the Operator. Contact information can be found in the imprint of the website at www.lelo.com.

The giveaway is held under the laws of Sweden. Any dispute related to the giveaway or its terms shall be exclusively settled by the District court of Stockholm.

If any provision of these terms of giveaway participation is or becomes invalid as a whole or as a part, this shall not affect the validity of these terms and conditions. Instead of the ineffective provision, the legally permissible provision which most closely approximates the meaning and purpose expressed in the invalid provision shall apply. The same applies in the event of the existence of a loophole in these terms of giveaway participation.

Changes to the Giveaway Terms and Conditions

These giveaway Terms and Conditions are subject to change by the Operator at any time without notice.
